Important Disclaimers:

Colors may vary: Screen displays differ; artwork colors may appear slightly different in person
Handmade variations: Original paintings are handmade; minor variations are inherent to the artistic process
Print-on-demand quality: POD products are produced after your order; print quality meets Printify’s standards

No Liability for Variations:
We are not responsible for minor color variations between screen display and physical product, provided the product substantially matches the description.

Availability

Original Paintings:
Original artworks are one-of-a-kind. If an original is sold, it will be marked as unavailable. We cannot guarantee availability until payment is confirmed.

Print-on-Demand Products:
POD products are produced after your order. Occasionally, Printify may discontinue products or run out of stock. If this occurs, we will:

Notify you within 2 business days
Offer a full refund or substitute product
Process refunds within 5-10 business days

Right to Refuse Orders:
We reserve the right to refuse or cancel orders at our discretion, including:

Suspected fraudulent transactions
Errors in pricing or product information
Orders that violate these Terms
Orders from prohibited jurisdictions

If we cancel your order, we will notify you and issue a full refund.

3. Pricing and Payment

Pricing

All prices are listed in United States Dollars (USD).

Pricing Accuracy:
We strive for accurate pricing but may make errors. If we discover a pricing error:

Before Shipment: We will contact you to confirm the correct price or cancel the order
After Shipment: We generally honor the price you paid

Price Changes:
Prices may change at any time without notice. The price in effect at the time of your order confirmation is the price you pay.

Taxes:

Sales Tax: Charged on orders shipped to addresses where we have a tax obligation (calculated at checkout)

4. Shipping

Summary:

Shipping is free on all US orders.
We currently ship only within the United States.
Original paintings typically ship within 7 business days.
Print-on-demand items generally ship within 3–5 business days after production.

Shipping Locations

We currently ship to addresses within the United States only (including Alaska, Hawaii, and Puerto Rico).

International Orders:
We do not currently offer international shipping. Orders with international shipping addresses will be canceled and refunded.

Shipping Costs

All shipping is FREE for US orders. Shipping costs are absorbed in our product pricing.

Shipping Timeframes

Original Paintings:

Processing time: 5-7 business days
Shipping time: 3-7 business days (depending on carrier and destination)
Total delivery: 8-14 business days from order confirmation

Print-on-Demand Products (Prints, Merchandise):

Production time: 3-5 business days (Printify)
Shipping time: 3-7 business days
Total delivery: 6-12 business days from order confirmation

Delays:
We are not responsible for delays caused by:

Shipping carrier issues
Weather or natural disasters
Customs (not applicable for US-only shipping)
Incorrect shipping addresses provided by you

Tracking

Tracking Information:
All shipments include tracking. You will receive a shipping confirmation email with tracking number once your order ships.

Original Paintings:
Shipped via USPS or UPS with full insurance and tracking.

POD Products:
Tracked shipping provided by Printify.

5. Returns and Refunds

Summary:

Original paintings: 14-day return window; buyer pays return shipping unless the item arrives damaged or defective.
Print-on-demand products: 30-day window for manufacturing or shipping defects, handled through Printify.
Incorrect or damaged items: full refund or replacement, and we cover return shipping.

Original Paintings

Return Window:
You have 14 days from delivery to return an original painting.

Conditions for Return:

Item must be in original condition (undamaged, unaltered)
Original packaging preferred (but not required if unavailable)

Return Shipping:

Buyer’s Responsibility: You pay return shipping unless the item arrived damaged or defective
Our Responsibility: We pay return shipping if item is damaged, defective, or incorrect

Refund Process:

We provide return shipping instructions
Ship item back (insured shipping recommended)
Refund processed within 5-10 business days after we receive the item

Damaged Items:
If an original painting arrives damaged:

Print-on-Demand Products

Printify Quality Guarantee:
POD products (prints, merchandise) are covered by Printify’s quality guarantee.

Return Window:
30 days from delivery for defective or damaged items.

What Qualifies:

Printing defects (misprints, color errors, quality issues)
Damaged in shipping
Incorrect item sent

What Does NOT Qualify:

Buyer’s remorse
Minor color variations from screen to print (normal)
Size dissatisfaction (check product descriptions carefully)

Return Process:

We evaluate with Printify
If approved: Replacement or full refund
Printify handles return logistics

Return Shipping:

Defective Items: We cover return shipping
Non-Defective: Buyer pays return shipping (returns rarely accepted)

Refund issued to original payment method
Bank processing may take additional 3-5 business days

6. Intellectual Property Rights

Copyright Ownership

All artwork, images, and designs on this website are protected by copyright law and are owned by Keenan Staffieri and/or Project Infinity LLC.

What You Own When You Purchase

Original Paintings:
When you purchase an original painting, you own the physical artwork but NOT the copyright or reproduction rights.

You MAY:

Display the artwork in your home or private space
Resell the physical artwork (copyright remains with the artist)
Photograph the artwork for personal use (e.g., share on social media with credit)

You MAY NOT:

Reproduce the artwork (prints, merchandise, digital copies)
Create derivative works based on the artwork
Use the artwork for commercial purposes
License the artwork to others

Fine Art Prints:
When you purchase a fine art print, you receive a limited, non-exclusive, non-transferable license to display the print for personal, non-commercial use.

You MAY:

Display the print in your home or private space
Photograph the print for personal use

You MAY NOT:

Reproduce or copy the print
Create derivative works
Use for commercial purposes (advertising, products, business decor)
Resell or distribute the image
Remove artist attribution or copyright notices

Merchandise:
Similar to fine art prints, merchandise featuring artwork designs is licensed for personal use only.

Website Content

All content on this website (text, images, logos, graphics, videos) is protected by copyright and trademark law.

You MAY NOT:

Copy, reproduce, or download images from our website
Use our logo, branding, or website content without permission
Scrape or extract data from our website

Exceptions:

Social media sharing with proper attribution (e.g., sharing product images on Instagram with credit to @keenan.staffieri)

Damages Cap

Color variations: Differences between screen display and physical product
Shipping delays: Delays caused by carriers, weather, or other factors beyond our control
Printify quality: While we work with reputable partners, Printify is responsible for POD product quality
Third-party websites: Content or actions on external websites linked from our site
User errors: Incorrect shipping addresses, order mistakes, or payment issues

Exceptions

This limitation does NOT apply to:

Personal injury caused by our gross negligence or intentional misconduct
Fraud or fraudulent misrepresentation
Violations that cannot be waived under California law
Death or personal injury caused by defective products

9. Indemnification

10. Dispute Resolution

IMPORTANT: This section governs how disputes are resolved and includes a class action waiver.

Informal Resolution

Step 1: Contact Us First
Before filing any legal action, you agree to contact us at hello@keenanstaffieri.com to attempt informal resolution. Many disputes can be resolved quickly through direct communication.

We will respond within 10 business days with a proposed resolution.

Governing Law
